Terms of Service

1. Acceptance of Terms

By accessing and using the Nick Christenson State Farm Agency Platform ("the Platform"), you agree to be bound by these Terms of Service. The Platform is an internal employee management and communication tool provided exclusively for use by employees and authorized personnel of Nick Christenson State Farm. If you do not agree to these terms, please do not use the Platform.

2. Description of Service

The Platform provides the following services to authorized employees:

• Internal employee directory with contact information and profiles
• One-on-one meeting notes and performance tracking
• Weekly pulse surveys for employee engagement monitoring
• Goal setting and progress tracking
• Time-off request management
• Team announcements and communications
• SMS text message notifications for work-related reminders and updates
• Swag store for team merchandise

3. SMS Text Messaging Terms

By providing your mobile phone number and enabling SMS notifications on the Platform, you expressly consent to receive text messages from Nick Christenson State Farm. The following terms apply to our SMS messaging program:

Opt-In

You opt in to receive SMS messages by entering your phone number in the Platform's notification settings and enabling SMS as a notification channel. Consent is not a condition of employment. You may use the Platform without enabling SMS notifications.

Opt-Out

You may opt out of SMS messages at any time by:

• Replying STOP to any text message you receive from us
• Disabling SMS notifications in your Platform notification settings
• Contacting your manager or administrator to remove your phone number from SMS notifications

After opting out, you will receive a one-time confirmation message. You will not receive any further SMS messages unless you re-enable notifications.

4. User Accounts and Access

Access to the Platform is granted based on your employment status and role within the organization. Your account is personal and should not be shared with others. Access levels are determined by your assigned role (Admin, Manager, or Team Member) and may be modified by administrators as needed. Upon separation from employment, your access will be deactivated.

5. Acceptable Use

When using the Platform, you agree to:

• Use the Platform only for legitimate business purposes related to your employment
• Keep your login credentials secure and not share them with unauthorized individuals
• Provide accurate and up-to-date information in your employee profile
• Respect the privacy and confidentiality of other employees' information
• Not attempt to access data or features beyond your authorized role level
• Report any security concerns or unauthorized access to your administrator

6. Data and Content

Information entered into the Platform — including meeting notes, pulse survey responses, goals, and profile data — is the property of Nick Christenson State Farm. This data is used for internal business operations, employee development, and team management. Confidential information such as compensation data is restricted to authorized personnel only. 7. Intellectual Property

The Platform, including its design, features, and underlying technology, is proprietary. You may not copy, modify, distribute, or reverse-engineer any part of the Platform. The State Farm name, logos, and trademarks are the property of State Farm Mutual Automobile Insurance Company and are used under license.

8. Disclaimer of Warranties

The Platform is provided "as is" and "as available" without warranties of any kind, either express or implied. While we strive to maintain reliable service, we do not guarantee uninterrupted access, error-free operation, or the accuracy of AI-generated content (such as meeting summaries or performance review drafts). AI-generated content should be reviewed by a human before being used for employment decisions.

9. Limitation of Liability

To the fullest extent permitted by law, Nick Christenson State Farm shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Platform, including but not limited to loss of data, missed notifications, or errors in AI-generated content.

10. Modifications to Terms

We reserve the right to modify these Terms of Service at any time. When material changes are made, we will notify employees through the Platform's announcement system. Continued use of the Platform after such changes constitutes acceptance of the updated terms.

11. Governing Law

These Terms of Service are governed by and construed in accordance with the laws of the State of Minnesota, without regard to its conflict of law provisions.
